RVmigo is a venue, never a party to the rentals arranged on it. These terms set out what that means for you: what we do, what we do not do, what you agree to, and what happens if something goes wrong. They are written in the plainest terms we can manage, and they say what the product actually does rather than what would be convenient for us.
These are the terms you agree to when you use RVmigo. They are an agreement between you and RVmigo, the operator of this site, and they cover browsing, listing an RV, requesting a booking, messaging, reviews, and everything else the site does. If you do not agree to them, do not use the site. They are not the rental agreement: that is a separate document between a host and a renter, and it has its own section below.
RVmigo is a venue. We publish listings and introduce RV owners to people who want to rent from them, and that is the whole of what we do. The rental itself is between the host and the renter: they agree the trip, they sign their own rental agreement, they settle the money between themselves, and they hand the keys over without us. We are not a party to any rental, and we are not any of the things a party would be. In particular:
You must be at least 18 and able to enter into a binding contract where you live. You must give accurate information about yourself and keep it current, use one account rather than several, and keep your password to yourself. You may not use the site if we have previously suspended or removed your account. We do not ask for or confirm anyone's age, so this is a promise you make to us rather than something we check.
You are responsible for what happens under your account, including anything someone else does with it. Tell us if you think someone has your password. We may suspend or close an account that breaks these terms, and the section on suspension below sets out what that means in practice.
Hosts complete an identity check before they can publish a listing, and renters before they can send a booking request. What that produces is a record that identity documentation is on file, and a badge saying so. It is not a background check, a driving-record check, a licence check or an assessment of anybody as a person, and RVmigo makes no representation about any user based on it. How the check runs depends on how the site is configured at the time; where it involves a scan of your face, the biometric policy is the document that governs it.
How we handle biometric dataIf you list an RV, you are telling us and every renter who sees it that:
The deposit, the mileage and generator allowances, the pet rules, the cancellation policy and any additional terms on a listing are the host's, not ours. We relay them; we do not set them, negotiate them or decide what they mean. A host can change what a listing says at any time, so the rental agreement generated for a booking is the record of what the two of you agreed for that trip, and it is the one to rely on if a listing and an agreement ever disagree.
A renter sends a booking request with their dates. The host has 24 hours to accept or decline before the request expires on its own. Some listings are set to confirm a request straight away without the host reviewing it first. Nothing is reserved until a booking is confirmed, and confirming one opens each party's contact details to the other so they can arrange the rest between themselves.
We generate a rental agreement for each booking from the details the two parties recorded. It is a sample template, provided as-is, between the host and the renter. RVmigo is not a party to it and not a signatory, does not give legal advice, and makes no representation that it is sufficient or enforceable anywhere. The host is responsible for whether the terms are legally sufficient in their state. A host may add their own terms to it; those are the host's words, and we neither draft nor review them. Each party accepts by typing their name, and we record the acceptance with a timestamp and a fingerprint of the exact text so neither copy can be changed afterwards without it showing.
Renters pay hosts directly. RVmigo never holds, receives, processes, transfers or refunds anyone's money, and no payment is made through this site. Both parties can record a payment here for their own records, which is a note that one of you says money was sent and the other says it arrived; it moves nothing and it is not our confirmation that anything was paid. You choose the payment method between yourselves, and what recourse you have if something goes wrong is whatever that method gives you, so choose one with recourse. Send money only to the payment details shown on your own booking, and never to anyone claiming to be RVmigo.
RVmigo takes 0% of every booking. There is no service fee for renters and no commission for hosts, the price a host sets is the price a renter pays, and none of it passes through us. We may later offer hosts optional paid extras such as promotion or a subscription, and if we do we will say what they cost before anyone buys one. Taking a cut of a booking is not something we will do.
A security deposit is a term between a host and a renter. The host sets it, the two of you settle it directly, and RVmigo never holds it, releases it, withholds it or decides who is entitled to it.
Each listing states the host's cancellation policy, and the one in force for a booking is recorded in that booking's rental agreement. Any refund is between the host and the renter: because we never held the money, RVmigo cannot issue a refund and does not decide whether one is owed. A host can cancel a confirmed booking before the trip starts, which releases the dates; what happens to money already sent is again between the two of them.
Insurance for a rental is arranged by the host. RVmigo doesn't provide, verify, or endorse coverage, and does not check whether a policy exists, is current, or would answer any particular claim. Before a listing can go live we ask a host for an insurer and a policy number, and a host may upload their own documents; a badge saying documentation is on file means those things were recorded, and nothing more. We never restate what a policy or a roadside membership covers, because the host's own documents are the only accurate source. Read them and confirm the details with the host before you book.
RVmigo does not calculate, display, collect, remit, withhold or report any tax, and there is deliberately no tax line in the price a renter sees. Rental income is generally taxable and any tax on a rental is the host's responsibility, as is working out what applies where they operate. None of this is tax advice; talk to an accountant about your own situation.
You keep ownership of everything you put on RVmigo: your listings and their photos, your reviews, your messages and anything else you write or upload. So that we can actually run the site, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, adapt for display, and publish that content in connection with operating and promoting the marketplace, and to let others see it where the product is designed to show it. You are telling us you have the right to give that licence, and that your content breaks nobody's copyright, trademark, privacy or other rights. Removing a listing removes it from the site going forward; it does not reach into a rental agreement already generated from it, or into someone else's copy of an email we already sent.
Only someone with a completed booking can review it. Both parties write independently and neither sees the other's until both are in or the window closes. We ask for reviews the same way of everyone, we never offer anything in return for one, and we never filter by how positive it is. A published review is permanent and cannot be edited or deleted; we may hide one that breaks the review policy, and a review being negative or disputed is not on its own a reason to hide it.
Before a booking is confirmed, a message carrying a phone number, an email address or a link is refused when you try to send it, and contact details open up for both parties once a host accepts. That is there to keep the early conversation on the site, where there is a record of it. Do not use the site to push someone into dealing off it in order to avoid that record, and do not use another user's contact details for anything other than the trip you are arranging.
Some of this repeats the sections above, and all of it is a condition of using the site. Do not:
You can report a listing, a review, a message or a user, and a host can block a renter from contacting them again. We may review and remove content that breaks these terms or our policies, and we may warn, suspend or close an account, take a listing down, or hide a review. We do not undertake to monitor everything on the site, we may act or not act at our discretion, and we do not tell one user what we decided about another. Removing content is not a finding about anybody, and declining to remove it is not an endorsement.
If something goes wrong on a trip, it is between the host and the renter. RVmigo does not adjudicate, does not decide who is right, does not award or withhold money, and runs no payment support. A dispute about money belongs with whatever payment method you chose, or with a small claims court. What we can offer is the record: the messages on the booking, the timeline of what happened to it and when, the rental agreement with its fingerprint and both acceptances, any condition readings and photos either of you recorded at pickup and return, and the payments you each logged. Either of you can print or show that record. The only thing we can do about another user is decide whether they keep access to the site.
The site uses other companies to do things like draw maps, look up addresses, send email, store files, run identity checks and record errors. Their services are their own, and we are not responsible for them. Where we link to someone else, including anyone offering insurance, the link is information rather than a recommendation, and you should judge them yourself.
The site itself, its software, its design and the RVmigo name and logo are ours, and these terms give you no right to use them beyond using the site as intended. If you believe something here infringes your copyright, tell us through the form linked at the bottom of this page with enough detail to find it and to show it is yours, and we will look at it and remove it where that is the right answer.
RVmigo is provided as is and as available, with no warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title or non-infringement. We do not promise that the site will be available, uninterrupted or free of errors, that anything on it is accurate or current, or that any listing, RV, host, renter, insurance policy or trip will be as described. We do not vouch for any user. Where the law does not allow a disclaimer this broad, it applies as far as the law allows.
To the fullest extent the law allows, RVmigo is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost income, lost data or loss of use, arising out of your use of RVmigo or out of any rental arranged through it, whatever the theory and even if we were told such damages were possible. Our total liability to you for any claim is limited to the greater of the amount you paid us in the twelve months before it arose and one hundred US dollars. Since we charge nothing for a booking, that figure will usually be one hundred dollars, and you should read it as the real limit rather than a formality. Some places do not allow limits like these, in which case this applies as far as the law allows.
You will defend, indemnify and hold harmless RVmigo and the people who work on it from any claim, loss, liability, damage, fine or cost, including reasonable legal fees, arising out of your use of RVmigo, anything you post here, any rental you enter into, your breach of these terms, your breach of any law, or your infringement of anyone's rights. This includes a claim brought by the other party to your rental, and a claim brought by someone else about that rental, such as a passenger, another driver or an insurer.
This section is about a dispute between you and us, not between you and another user. It applies to the fullest extent the law allows, and nothing in it stops either of us from reporting anything to a government agency.
We may suspend or close your account if you break these terms, if we think you are putting other people at risk, or if we have to. While an account is suspended you can still sign in and see your existing trips, but you cannot list, book, message or review. You can ask us to close your account through the form at the bottom of this page and we will do it by hand; there is no self-serve button for it yet, and we cannot erase things another person is relying on, such as a booking record, a rental agreement or a review they received. Anything in these terms that should outlast your account does, including the sections on liability, indemnity and resolving disputes.
We may change these terms. When we do, the version and date at the top of this page change with them, and if a change is significant we will say so rather than leave you to spot it. We record which version of these terms your account agreed to when it was created. Using the site after a change means you accept the current version.
These terms and any dispute arising out of them are governed by the laws of the State of California, without regard to its choice-of-law rules. Where a dispute is not resolved by arbitration under the section above, it belongs to the state and federal courts sitting in California, and both of us agree to those courts hearing it.
These terms, together with the privacy policy and the biometric policy, are the whole agreement between you and RVmigo about RVmigo, and they replace anything said before. If one part of them is held unenforceable, the rest stays in force. Not enforcing something once does not waive it. You may not transfer your rights under these terms; we may transfer ours if the business does. Nobody other than you and us gets rights under these terms. We are not responsible for delays or failures outside our reasonable control. We send you notices by email or by posting them here.
